Pitso Mosimane’s Legal Battle with Sundowns: Appeal Heard, Judgment Awaited

The legal dispute between coach Pitso Mosimane and Mamelodi Sundowns has
moved to the next stage, with an appeal hearing now concluded and a
judgment pending.

Mosimane and his agency, MT Sports—owned by his wife Moira Tlhagale—are
appealing a previous High Court ruling that ordered them to repay over
R7.9 million to Sundowns. The amount represents agent commission fees paid
in advance by the club, which Sundowns argued were subject to a “clawback
clause” in Mosimane’s contract after he left to join Al Ahly in September
2020, only four months into a new long-term deal.

In August 2025, Judge Shanaaz Mia ruled in Sundowns’ favour, instructing
MT Sports to refund the fees plus interest dating back to May 2021.
Mosimane and his legal team have contested the clause as “discriminatory,
against standard practice, and unconstitutional.”

The appeal was heard on 14 January 2026 in the Johannesburg High Court.
Eric Mabuza of Mabuza Attorneys, representing Mosimane and MT Sports,
confirmed to PSLSA that arguments were presented and the judgment has been
reserved.

“The case was argued on the 14th and the judgement was reserved, so we’re
just waiting for judgement,” Mabuza stated. When asked about the timing of
the verdict, he added, “It’s out of my control, we’re waiting for the
judge.”

The outcome remains awaited as speculation continues regarding Mosimane’s
potential return to Sundowns, a move that would add another layer to this
ongoing legal and professional saga.
